Property Purchases
We assist purchasers with the legal aspects of buying residential and commercial property, from reviewing the contract before exchange through to settlement.
Our work may include reviewing the Contract for Sale of Land, advising on special conditions, title matters, easements, covenants, restrictions, strata documents and other disclosure materials. We also assist with issues such as cooling-off rights, finance and deposit arrangements, FIRB approval requirements, foreign purchaser surcharge issues, off-the-plan purchase progress, developer notices, contract variations and pre-settlement requirements.
For first home purchasers, investors and overseas clients, we explain the process clearly and help coordinate the legal steps required to move from contract review to exchange, settlement and completion.
Property Sales
We assist vendors with preparing and managing property sale matters, including the preparation of Contracts for Sale of Land and the review of prescribed disclosure documents.
We advise on special conditions, settlement requirements, discharge of mortgage issues, deposit arrangements and purchaser enquiries. We also liaise with real estate agents, purchasers’ representatives, lenders and other parties involved in the transaction to help ensure the sale progresses smoothly.
Our role is to help vendors prepare properly before the property is marketed, respond to issues that arise during the transaction, and complete settlement in an organised and timely manner.
Off-the-plan and Strata Transactions
Off-the-plan purchases and strata properties can involve complex contracts, detailed disclosure requirements and ownership arrangements that differ from established properties.
We review off-the-plan contracts, sunset date provisions, draft strata plans, schedules of finishes, provisions allowing the developer to make changes, anticipated settlement timeframes and other disclosure documents. We help clients understand their contractual obligations and identify important legal and practical risks.
We also advise on strata matters that may affect the use and long-term ownership of the property. This may include by-laws, strata levies and special levies, common property, exclusive-use arrangements, restrictions on renovations, leasing or use of the property, and other issues relevant to the client’s intended use or future plans.
Commercial Property Matters
We assist with commercial property transactions, including the purchase and sale of commercial premises, mixed-use properties and property matters connected with business operations.
Where a transaction involves both property and broader commercial considerations, we review the relevant contracts, leases and other legal documents, advise on settlement obligations and help clients identify key legal and practical risks. We also assist with existing lease arrangements and other issues that may affect the use, operation or future value of the property.
